Role Summary This role is for a Senior Counsel Illicit Trade Prevention (ITP) within Litigation & Investigations Group (L&I), which is part of PMI’s Law & Compliance Department. The main purpose of the role is to lead legal counseling and advice to PMI’s ITP in the U.S., to safeguard the Company’s reputation by ensuring that our products are not diverted into illicit channels, to protect the Company’s business and the value of our brands against counterfeiting and unfair competition, and to contribute to positioning the Company as a credible partner for U.S. law enforcement and government authorities, and, beyond, as a reputable Company with our legal-age consumers and the broader society. The role implies being the center of expertise for ITP legal matters in the U.S. and establishing a legal strategy supporting ITP for the U.S. Key responsibilities • Assist and advice the ITP U.S. Head to set the strategy for ITP in the U.S., while ensuring compliance with applicable laws and relevant PMI policies. Align with the priorities of the Law & Compliance and External Affairs teams, with full understanding of the legal and regulatory environment in the U.S. • Design and lead a strategy encompassing legal actions and activities aimed at countering the illicit trade in Smoke Free Products (SFP) in the U.S. and protecting PMI products, including by assisting authorities in relation to detentions or seizures of suspected illegal tobacco and other nicotine containing products. • Assist ITP U.S. Head and PMI U.S. to protect the integrity of our SFP and their supply chain by implementing proper supply chain controls in line with PMI anti diversion and know your customer policy and programs, and applicable legislation. • Advise PMI U.S. on track and trace measures and legislation applicable to PMI U.S. products. • Support efforts to promote regulatory frameworks enhancing deterrence and enforcement against illicit trade perpetrators at federal and state level. • Advice on interactions with national and supra-national authorities to foster support and commitment to fight illicit trade, promote and implement enforcement strategies that deter illicit activities involving nicotine containing products, in line with our focus on smoke-free vision, and address derived threats to the integrity of smoke-free products or their respective categories in the U.S. • Advise on how to establish assistance frameworks to institutionalize the cooperation with U.S. law enforcement authorities. • Ensure coordination of activities with the ITP Law team and the broader Law & Compliance department and other relevant functions within the organization. • Establish effective and efficient working relationships with key stakeholders, including law firms, suppliers, academia, and anti-counterfeit groups. • Manage efficiently assigned resources. Desired Profile - Law degree with strong academic credentials. - Previous admission to practice law. - 10+ years' experience as market and/or functional lawyer, with commercial, IP, regulatory and/or litigation matters in a law firm, PMI or other multinational corporations. - Strong preference for prior experience in addressing illicit trade issues on excisable or regulated consumer goods (e.g. alcohol, tobacco, petrol, telecom or pharma). - Excellent understanding of the functioning of the U.S. legal system at federal and State level. - Ability to interact with multiple internal and external stakeholders in the U.S. and abroad, including law enforcement authorities, suppliers, law firm, organizations, bar associations, academia/universities and competitors. - Communications, influence, analytical and organizational skills. - Great collaborator on project-based work. - Ability to efficiently manage assigned legal fees budget. - Ability to take data driven decisions. - Flexible to adapt to new realities and able to take decisions even in uncertainties. Expected salary range: $200,000.00 - $310,000.00 per year, varies based on experience, along with comprehensive benefits package that includes bonus and 401k. #LIHYBRID
